Program Outcome 2 Demonstrate the ability to apply principles of criminal law to criminal justice practice and understand the civil liabilities of criminal justice agencies and practitioners Assignment Imagine you are the Chief of your local police enforcement agency and one of your officers was involved in a shooting incident that resulted in injuries to a robbery perpetrator. Review the following scenario and identify the legal issues that may arise from the police officer’s actions, if any. Be sure to carefully review the facts as presented and summarize in an official letter to the Mayor of your city, the justification of the officer’s actions by incorporating areas of the criminal law. In a separate letter, and based on the same scenario, take the opposite approach and submit a letter to the Mayor stating how, as a defense attorney, the officer that was involved in the shooting was civilly liable and the City is vulnerable to a lawsuit that is going to be filed. Scenario: Police Officer Jones, in full uniform, was walking the midnight shift in a high crime area at approximately 2:00 AM and as approached by a civilian that told Officer Jones she had been robbed and beaten by someone wearing a red shirt and white pants. The perpetrator was wearing a ski mask so she was unable to determine the gender/sex of the individual, as well as the race/ethnicity. However, she was able to inform Officer Jones that the perpetrator was approximately 5’8” tall and had a gun. The perpetrator stole her wallet and was holding it when he/she fled the scene, which was only a minute or two earlier. Officer Jones called for medical assistance and for backup as well. While waiting with the victim for medical personnel to arrive, Officer Jones spotted an individual that fitted the description about a block away from the scene. Though it was very dark, Officer Jones observed the white pants and dark shirt as well as some type of object in the individual’s right hand. Officer Jones walked toward the individual and was approximately 20 feet away when he identified himself as a police officer and told in a loud, clear voice , “Stop, Police!” “Drop the object in your hand and place your hands above your head.” However, the individual refused to comply with Officer Jones’s lawful commands and proceeded to walk towards Officer Jones with the object in is right hand. At this time Officer Jones again shouted the same words but the individual refused to comply, and continued to walk towards Officer Jones. Officer Jones was now able to determine that the object in the individual’s right hand appeared to be a silver and black gun. The subject, now approximately 7 feet from Officer Jones, still refused to comply with his request and pointed the gun at Officer Jones. Officer Jones drew his weapon and fired at the individual, hitting him in the left shoulder. The individual fell to the ground and Officer Jones approached him and called for additional medical personnel. The gun was secured by Officer Jones at the scene. The individual was taken to the hospital and was labeled as stable. Detectives from the police department investigated and processed the scene and took into the possession the black and silver gun that was pointed at Officer Jones. An analysis of the gun indicated that it was a toy model version of a Glock 26 handgun pistol, but had no capabilities to discharge any bullets. Further investigation revealed that the victim identified the individual as the perpetrator of the robbery and the victim’s wallet was located on the perpetrator’s person.
