Question: Jomo is a builder and a property developer. Two years ago he bought a house on Clovelly Street. He leased the house to four students of the local university. For three months in a row the students owed rent in arrears of £50 altogether. In the fourth week of March he offered his tenants a chance to pay the arrears of £50 in two days. However, instead of paying the money, the tenants went out to a night club, thereby missing the deadline of 9pm on 1st April. In anger Jomo decided to teach his tenants a lesson. His resolve was given a boost by an offer from a Japanese businessman, which he received on 2nd April, to buy his (Jomo’s) house urgently at twice its value because it was very close to the city centre. In his haste to move the students out of his property, Jomo cut off the supply of electricity and water to the house. He also instructed his workmen to remove the toilets from the house under the pretext of necessary renovation works. This caused the tenants considerable inconvenience for well over a fortnight. When the students complained to Jomo, he told them to endure those conditions or move out of his property. He also told them: “Freedom of choice is a fundamental human right. Besides, you owe me some rent. Now go to hell”. In the third week of their ordeal, they refused to move into another house, owned by Jomo, as that would cost them £30 more per month and that house was situated half a mile away. A week before then, in another part of the city, PC Signa, to whom Lombroso had reported a break-in at his flat, forged Lombroso’s signature on a letter, supposed to have been written by Lombroso, withdrawing his report. This was disclosed to Lombroso by PC Teller, who did not get on well with PC Signa. Advise the students and Lombroso on their remedies. The assignment will be assessed using the following outcomes: Understanding and Knowledge: 1) Demonstrate an in-depth knowledge of the concepts, principals and main procedural rules governing civil remedies in English Law. 2) Identify legal problems in that area of law and apply the relevant law to them. Cognitive skills: 1) Analysing legal problems within the law relating to civil remedies. 2) For the purpose of identifying and analysing such legal problems, carry out guided research using both primary and secondary sources (including paper and electronic resources). Practical and professional skills: 1) Do independent planning and work in areas of the law relating to civil remedies already studied. 2) Do independent research on areas of the law of civil remedies not yet studied. Transferable (general) skills: 1) Analyse, judge critically, synthesise and evaluate in a systematic way different concepts, propositions and arguments in the law relating to civil remedies (including evaluation of alternative remedies). 2) Justify law reform in this area of the law. The assignment must be cited in numerical citation. Cases and statutes must be underlined in the assignment.
