Marking Criteria 1.Places the given case within its European context 2.Demonstrates an understanding of the law making process within the EC and its implementation in member states. 3.Illustrates the principles and mechanisms for consultation. 4.Work is clearly presented, word processed and written in a clear and understandable style. Task How should a judge sitting in a national court resolve a case that appears to raise issues within the principles of EC Law? Discuss, using the issues, principles and processes involved in Orde des Barreaux Francophones et Germophone and others v Conseil des Min-istress (2007) All ErR (EC) to illustrate your essay. Whilst it is reasonable for you to consider factual issues within the case please do not use more than 300 words of those allowed for this purpose. Instead take themes from the case to illustrate your answer, which should also refer to other cases from your reading as appropriate. It is however essential that the case forms a central focus for your essay. Descriptions of EU legislation and institutions will not by themselves secure a pass mark for this portfolio element. Amongst other issues you should consider within your essay: •How EC directives are received into the law of this country and/or become effective •Why references are made to the ECJ, how the court operates and the effects of its recommendations on the national court.
