The Problem Exercise Solutions should identify the legal issues raised by the factual circumstances given, prioritise the issues for analysis, and record the relevant law and its application. Submissions should contain clear reasoned advice. The solutions should be word-processed and spell-checked. Hamish McFeather makes hand-made darts, which are sold under the name THROW ARROWS. They are made from coloured plastic and real parrot feathers, and are blue and gold in colour (the Scottish team colours). On the upper surface of the dart they also have raised ridges in a chevron shape. These make the darts very easy to grip (especially when nervous), as well as being decorative in appearance. Hamish has plans to begin manufacturing clothing in the Scottish Darts Team strip to add to his range of products. The strip is blue and decorated with gold chevron-shaped stripes. The stripes are knitted into the fabric in such a way that they stand out from the material. Didas Inc, a US company, have registered chevrons as a Community trade marks for trainers. They advertise widely, and the trainers can be bought on Internet, but they have no outlet in Scotland. Hamish is also an amateur sportsman. He is Captain of the Scottish Darts team which recently won the World Darts Championships, rocketing the team to unaccustomed national prominence. Hamish has a distinctive and characteristic expression when he throws the dart. Like tennis ‘grunters’ he claims that it is involuntary and that it enhances his concentration and poise, enabling him to achieve total balance as he throws. He is certainly noted for his accuracy. Photographers delight in capturing this expression, which they call ‘The Glower’. Recently Hamish and his family posed for photographs privately in their garden. The camera was subsequently stolen. Unfortunately for Hamish, who has allowed the press to cultivate an image of him as an upstanding family man, he is observed emerging from a pub with a scantily dressed young lady hanging from his arm by the photographer from The Thursday Sport, who are now pressing him for an interview. Sensing that there is much to be gained from the team’s sporting success, Hamish engages you as his legal adviser on intellectual property.
