Casenote Casenote: Hackensack Riverkeepers v. Delaware Ostego Corp., 450 F. Supp. 2d 467 (E.D.N.J. 2006). If you have been assigned a case, you will be writing a relatively short (ie., 5-7 pages, double-spaced) casenote, which is something like an extended brief. The facts and judicial history section may be a little longer, and you will also include an epilogue (explained below). In a casenote, the facts and judicial history section is often named something like “Background to the Case”. Here you will flesh out the litigants’ narrative and counter-narrative stories, as described by the judge in the decision about which you are writing the casenote. What is the statutory context within which the dispute is arising, and what specific agency action is the subject of the dispute? What principles of judicial review on questions of fact and law are the subject of the case? You can then bundle the Questions of Law, Holdings, and Reasoning into the second section of your casenote, and the Epilogue will be your third. In this last section, depending on how recently your case was decided and at what level in the court system, you can address questions such as: What has happened since the case you briefed was decided? What other important cases might have cited it as precedent? Has doctrine on this point changed any since your case was decided? Has Congress taken any action in light of this decision? One good way to go about this is to do a key word search of the caselaw, setting the search dates to the year of and years subsequent to the case you are briefing. You may also find news media accounts of events occurring after the case was decided. If a very recent decision, you can also close simply by speculating on what the probable effect of the decision in your case might be on the future of this particular issue in environmental law and policy.
