Case Facts/Task Gabriella verbally agreed to purchase Bob’s iPod for $100. Bob needed the money fast so he told Gabriella that “time was of the essence” and that he needed to have the cash payment by Friday at noon or the deal was off. He told Gabriella to meet him at the Starbucks near campus on Friday before noon. Gabriella, in anticipation of purchasing the iPod, drove across town to purchase some accessories from a friend for $40. On her way back to meet Bob, Gabriella’s car swerved to miss a dog crossing the road and accidentally crashed into another car. She was unable to make her noon appointment to meet Bob. Bob waited until 12:45 for Gabriella. At 12:50 Bob sold the iPod to a friend for $80. Gabriella got mad and threatened to bring legal action against Bob for specific performance. She really wanted the iPod now that she had purchased accessories for it. Legal Issue This section is limited to the statement of the issue only. The stated issue should be limited to one or two sentences. Laws This is where you describe/define the laws that apply. You should copy the laws directly from the legal text or online lecture notes to avoid any inadvertent alteration of the law’s meaning. A citation of all items copied or paraphrased from the textbooks or other resources must be included. You may use any form of citation as long as we can easily find the source. Application Here is where you analyze the case. NOTE – the best way to ensure that you fully analyze each law you cited above is to copy each of your laws from above into this section and analyze each law in accordance with the facts provided.
