Assume that in 2005 the Council issued a directive on digital electronic viewer specifications (“the directive”). The directive was to be implemented by all Member States by 1 July 2007 In the UK, the directive was deemed to be contentious. It was considered that the directive would expose the precarious UK digital electronic viewer industry to competition from digital electronic viewers from other Member States of the Community. Furthermore, there was severe pressure on Parliamentary time which meant that the UK government was not able to alter the pre-existing digital electronic viewer specification regulations to make them accord with the directive. In August 2007, Pedro, an importer of digital electronic viewers, had a consignment of German digital electronic viewers held up by customs in Felixstowe. He was told that the digital electronic viewers met the specifications of the directive, but not the more stringent conditions contained in the UK regulations. The digital electronic viewers were not released to him until 1 February 2008 In December 2008, the Commission commenced proceedings against the UK. Following the issue of a reasoned opinion, the government made delegated legislation to implement the directive. The delegated legislation came into force on 1 February 2009. Pedro has suffered considerable financial loss as a result of the digital electronic viewers being held up in customs. Advise Pedro on what rights he may have against the UK government.
