Option 1 - You are required to prepare a research paper, comprising original work, on a topic agreed between yourself and your Unit Adviser. You may research a subject that has relevance to your own area of employment or personal interests. You will need to provide your Unit Coordinator with a brief written proposal for a topic by Saturday 12 April 2008. The proposal should be not more than 500 words in length and clearly state: - the legal issues raised by the topic - why this topic is important, including references to relevant legal sources and related literature (eg. cases, legislation, government reports etc) - a statement of methodology indicating how you intend to carry out the project. Option 2 - If you have difficulty deciding upon a topic of your own, as an alternative you may choose a topic from a list of suggested current insurance law topics that will be provided on MUSO. You will need to notify your Unit Coordinator of your preferred topic by Saturday 12 April 2008. Tasks The object of the research paper is for you to: 1. analyse the legal concepts associated with the selected area of research; and 2. explain the legal rights and obligations associated with the parties that are the subject of the research. Depending on the research subject selected, the following issues may need to be addressed: 1. Interpreting the contractual rights and obligations in terms of the economic impact upon the parties as a result of a failure to fulfil obligations and the probable consequences of a loss. 2. An analysis of the allocation of the loss in 1 above according to legal considerations of foreseeability, remoteness and public policy. 3. Suggest how the consequences of such a legal allocation of the loss might be modified or abrogated by risk management facilities such as: a. primary contractual arrangements; b. insurance; c. alternative risk transfer/risk funding mechanisms or other agreements such as guarantees, letters of comfort and indemnities. Where possible, the research paper should indicate how your research impacts directly on a corporate insurance program. Word limit = 3,000 words Marks available (1) identify and conduct research on current legal issues relating to corporate insurance programs (objectives 3 and 4); (2) complete the stated tasks in a well reasoned paper of professional standard, using conventional style and appropriate acknowledgement of sources.
